A copy of the certificate should be included with the tenancy agreement.<\/p>\n\n\n\n<p>If a certificate has not been obtained the tenant may consider it a breach of the property owner\u2019s duty to comply with all health and safety laws.<\/p>\n\n\n\n<p>The condition of the pool should be noted in the&nbsp;<a href=\"https:\/\/www.rta.qld.gov.au\/starting-a-tenancy\/entry-condition-report\">Entry condition report<\/a>&nbsp;(Form 1a).<\/p>\n\n\n\n<p>All temporary pools and spas (which can be filled with water to a depth of 300mm) must also comply with the pool safety laws and may require fencing requirements. Tenants should obtain permission from the property owner before installing a temporary pool.&nbsp;<\/p>\n\n\n\n<p>Pool safety laws apply to the property owner and tenant. Contact the&nbsp;<a href=\"https:\/\/www.epw.qld.gov.au\/services\/building-plumbing\/pool-safety\">Department of Communities, Housing and Digital Economy<\/a>&nbsp;for more information.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pool maintenance<\/h3>\n\n\n\n<p>The maintenance of a pool should be covered in the special terms of the tenancy agreement.&nbsp;The property manager\/owner cannot enforce a specific business for cleaning the pool.<\/p>\n\n\n\n<p>Generally, the tenant is responsible for everyday maintenance such as clearing leaves from the pool and may be responsible for regular maintenance.
